WHAT to expect

Brazil Employment Law

The Consolidation of Labour Laws, also known as the “Labour Code” (CLT), the Brazilian Federal Constitution, and other auxiliary norms, like as decrees and regulations passed by the Ministry of Labour and Employment, are the main sources of employment law in Brazil. Collective bargaining agreements may specify annual salary increases by category and employee benefit rights.

Termination is at will, with notice being required for terminations without cause. Certain employees are protected from termination, for example, pregnant employees, those injured at work, or certain union representatives.

Terminations for cause must be for specific reasons relating to the employees behaviour. To avoid potential legal complications, employers will often seek to amicably agree to terminate employment by offering severance payments.

Payroll in Brazil

Brazil operates under laws regarding equal pay for equal work. Paragraph 1, Section 461 of the CLT defines “equivalent work” as work of the same productivity and technical quality performed by employees with no more than a four-year gap between their time working for the same firm and no more than a two-year gap occupying the same post. Failure to comply risks litigation and fines.

The 13th month wage is necessary in Brazil. All employees who’ve worked for the company for the previous 12 months must receive this payment. Later hires receive a percentage of the 13th wage (monthly salary divided by 12 and multiplied by months worked in the year). When hiring in Brazil it is important to be clear if the salary being offered is inclusive of this 13th salary payment.

Every May/June, union negotiations occur. All employees receive Union-negotiated compensation increases and benefits. After talks, a collective agreement is produced with year-end adjustments and a pay rise backdated to Aug. 1.

Payrolling the employees is a key part of the service offered by an employer of record company. The EOR will calculate and remit all taxes, social securities and similar payments, on behalf of both employer and employee. The client will be invoiced in advance by the EOR company, for the total cost of the payroll.
