Employer of Record Germany - Employment Contract

Germany has strict labour laws, and businesses that wish to engage in labour leasing (such as a co-employment arrangement) must adhere to stringent guidelines set forth in the German Employee Leasing Regulations (Arbeitnehmerüberlassung).

The AüG licence, which is provided by the Bundesagentur für Arbeit (German Labor Ministry) and regulates what can and cannot be done, is required for businesses that seek to lease labour to their clients. 

Several noteworthy details include:

Employees may only be leased for a maximum of 18 months. After that, if the client wishes to retain the employee’s services, they must hire them directly.

The organisation holding the licence is required to enter into a direct contract with the party receiving the labour. No agencies, middlemen, or managed service providers are involved in the direct contractual chain.

All employees who are hired on a temporary basis by a client should be given equivalent benefits (known as meeting the comparable terms of hire). This is a requirement of the contract, and both the lessor and lessee are responsible for exercising due diligence in compiling the contractual terms for the leased employee.

Payrolling the employees is a key part of the service offered by an Employer of Record company. The Employer of Record will calculate and remit all taxes, social securities and similar payments, on behalf of both employer and employee. The client will be invoiced in advance by the EOR company, for the total cost of the payroll.

Yes. Our clients are free to dictate the structure of the employees’ remuneration including any bonuses or commissions they wish to offer. In some countries, there is a statutory requirement to provide “bonuses”, for example in the form of Christmas or holiday allowances.
