Do I need a Work Permit or Visa to work in the Netherlands?

Whilst Agility EOR does not generally “sponsor” Work Permits (this practice is not always compatible with the EOR/PEO model), we can generally support candidates needing a work visa in the Netherlands.

European Union/European Economic Area/Swiss nationals are exempt from needing a work or residency visa. However, in order to qualify for social security payments, they will need to obtain a residency permit.

Before entering the Netherlands, all other foreigners who want to stay longer than three months must get an “authorization temporary stay” (MVV) from the Dutch embassy or consulate in their home country. A work permit must also be approved before they can commence employment. Work permits applications must be submitted by the employer, alongside evidence that attempts have been made to employ a Dutch, EU, EEA or Swiss national.

Exceptions to the work permit requirement are provided under the International Commercial Trade Regulations Program. This allows for certain pre-approved activities, intra-company transfers, and the employment of highly skilled personnel.

Payrolling the employees is a key part of the service offered by an employer of record company. The EOR will calculate and remit all taxes, social securities and similar payments, on behalf of both employer and employee. The client will be invoiced in advance by the EOR company, for the total cost of the payroll.

Yes. Our clients are free to dictate the structure of the employees’ remuneration including any bonuses or commissions they wish to offer. In some countries, there is a statutory requirement to provide “bonuses”, for example in the form of Christmas or holiday allowances.

Yes. Agility EOR will calculate what pay is due upon termination of an employee, factoring in such things as any untaken leave entitlements.
