Spain Holiday Entitlement
Individually or collectively agreed upon yearly holidays may not be less than 22 working days or 30 calendar days, including paid time on Saturdays and Sundays, in length.
The employee must take their holidays within the calendar year, as required by law, but the employer may agree to carry over any unused holidays to the following year. In this situation, the employee is required to submit a particular, official request in writing that the business can approve. An employee cannot be forced by the firm to carry over a holiday.
Spain Maternity Leave

- 6 required postpartum weeks must be uninterrupted and full-time (administrative or judicial resolution in case of adoption). The original mother is allowed to prepone this time up to four weeks before the due date.
- The subsequent 10 weeks may be taken in weekly blocks, either continuously or intermittently, within the 12-month period following the birth or, in the event of an adoption, following administrative or judicial decision
Social Security covers maternity and paternity pay; a certificate can be obtained from the Social Security office. Both the worker’s age and the length of her contributions to the general social security programme determine the eligibility requirements for maternity benefits.
It’s vital to remember that requests for Spain Maternity leave must be made for complete seven-day weeks.
Spain Sick Pay
- The initial three days do not pay.
- The employer will pay 60% of wages from the fourth day of absence through the fifteenth day, inclusive.
- Beginning on day 16, social security begins to compensate the employer for a portion of the wage (60% up until day 20, 75% thereafter).
The employee will earn up to 12 months of full pay if they are sick for a sustained period of more than 30 days (partially paid by the employer).

Payrolling the employees is a key part of the service offered by an employer of record company. The EOR will calculate and remit all taxes, social securities and similar payments, on behalf of both employer and employee. The client will be invoiced in advance by the EOR company, for the total cost of the payroll.
