Employee is employed by you and paid by you from your overseas Company

  • Pros: This option appears to offer the most cost-effective and straightforward solution.
  • Cons: The inability to cover mandatory social security contributions, as well as being subject to Dutch employment law, may pose challenges for the employee.

Entity Set-up

  • Pros: Opting for this choice could save you a substantial amount of money when hiring a large workforce of over 15 people.
  • Cons: Setting up a legitimate business entity and adhering to the strict employment and tax laws in the Netherlands can be a major financial and time investment, particularly for smaller businesses. This method may not be feasible for companies with fewer than 15 employees.

Using an Employer of Record
  • Pros: In the Netherlands, opting for an Employer of Record service is the ultimate time and cost-saving strategy for handling payroll, HR, and compliance duties, especially for forming employer-employee connections with teams under 15 members.
  • Cons: Hiring a significant number of employees can be expensive. Selecting the right Employer of Record provider may pose a challenge.

  • Cons: Employing a full-time worker who is solely committed to your company without the correct employment status is illegal in the Netherlands. The consequences of misclassification could lead to fines or even criminal charges.

In the Netherlands, if a worker is exclusively dedicated to your company and follows the instructions and tasks set by your organization, they must be categorized as an employee. Not complying with this regulation is considered a violation of Dutch employment legislation.
