Portugal provides some of the most comprehensive parental leave entitlements in Europe, and for overseas employers, understanding how they work is essential. The system is largely state-funded, which is good news for employers, but the administrative and compliance obligations that sit alongside it are significant. Getting them right protects both your business and your employee.

Portuguese employment law provides strong protections for pregnant employees and new mothers. Failing to manage the process correctly, whether through incorrect payroll handling, misunderstanding what the state covers, or failing to observe the employee's right to return, can expose businesses to significant legal and financial risk.

For overseas businesses without a local entity, using an employer of record in Portugal means these obligations are managed on your behalf, from the initial notification through to the employee's return to work.

What is the maternity leave entitlement in Portugal?

Employees in Portugal are entitled to 120 days of initial parental leave (licença parental inicial), which can be taken entirely by the mother or shared with the other parent. This leave is fully paid, funded through the Portuguese Social Security system.

In practice, mothers typically take the full 120 days, which equates to approximately 17 weeks. This period must begin no later than four weeks before the expected due date, meaning a portion of the leave is taken before the birth.

Beyond the initial 120 days, employees can also take additional parental leave of up to three months, though this extended period is unpaid by the state.

Portugal also provides:

  • A mandatory six-week post-birth period during which the mother must take leave.
  • Protection against dismissal from the moment of confirmed pregnancy until 60 days after maternity leave ends.
  • The right to return to the same or equivalent position after leave ends.
  • The right to attend medical appointments during working hours without loss of pay.

What does the state pay during maternity leave?

The Portuguese Social Security system covers maternity pay during the initial 120-day period at 100% of the employee's reference salary, calculated on contributions over the preceding six months. In most cases the employee receives their full salary during leave, but the source is the state, not the employer. The employer is not required to top up the state payment for the standard initial period, but retains administrative and compliance responsibilities throughout.

What is the employer responsible for during maternity leave?

While the state covers the core maternity payment, employers retain specific obligations:

  • Maintaining the employee's Social Security record and processing contributions correctly throughout the leave period.
  • Managing payroll correctly at the start and end of leave, including any employer-paid elements such as meal vouchers or transport allowances.
  • Preserving continuity of service and ensuring annual leave continues to accrue.
  • Protecting the employee's role and ensuring they can return to the same or equivalent position.
  • Notifying Social Security correctly and managing all required documentation.

Dismissing or placing a pregnant employee at risk without following the correct legal process is a serious breach of Portuguese employment law and can result in reinstatement orders and significant financial penalties.

How does maternity leave affect payroll in Portugal?

The transition to and from maternity leave requires careful payroll management. Employers must adjust payroll at the point leave begins, handle any employer-paid benefit elements correctly during the leave period, manage the return-to-work transition accurately, and keep records throughout as Social Security may audit payroll during or after the leave period.

What about paternity leave in Portugal?

Fathers are entitled to 28 mandatory days of paid paternity leave. 20 days must be taken immediately after the birth; the remaining 8 days within the first six weeks. Paternity leave is funded by Social Security at 100% of the reference salary. There is also an optional shared parental allowance of up to 30 additional days, funded at a reduced rate. Employers are responsible for managing the process and ensuring payroll is handled correctly throughout.

What protections do pregnant employees have in Portugal?

From the moment of confirmed pregnancy, employees cannot be dismissed without specific documented just cause and prior authorization from the Authority for Working Conditions (ACT). Night shift working can be suspended upon request. Employees have the right to attend medical appointments without loss of pay, and any discrimination related to pregnancy or maternity is prohibited. These protections continue for 60 days after maternity leave ends.

What happens when maternity leave overlaps with annual leave or probation?

Annual leave continues to accrue during maternity leave. An employee cannot lose unused leave entitlement due to pregnancy, and has the right to take any accrued leave before or after the leave period. Employers should account for this when planning workforce coverage.

If pregnancy arises during a probationary period, the employee retains full dismissal protections from the point of confirmed pregnancy. The probationary period does not override those protections. Employers should take legal advice before taking any action involving a pregnant employee on probation.
