After months in the making, Agility EOR has been granted an Arbeitnehmerüberlassung (AÜG) license, receiving official approval from the Federal Employment Agency, Bundesagentur für Arbeit. As this was our first time applying, successfully securing the license represents a major achievement, one that enables us to operate fully in Germany. This milestone reflects our continued commitment to compliance and excellence and allows us to support other businesses navigating this dynamic market.

What the AÜG License Means

The AÜG license is a testament to our ability to meet Germany’s rigorous standards for temporary employment services. The Bundesagentur für Arbeit conducts comprehensive checks on both the company and its representatives to ensure financial integrity and operational compliance. Companies must demonstrate a clean record of tax and social security obligations, as even a single arrears record can jeopardize the application. Responsible representatives are also required to provide a German certificate of good conduct, and, if applicable, a UK police clearance certificate for foreign nationals.

Achieving Our License

Obtaining the AÜG license isn’t a simple process as it involves submitting a comprehensive set of documents.  These include, but are not restricted to:

  • Main application form
  • Up-to-date extract from the German Commercial Register
  • Articles of Association and business registration
  • List of shareholders
  • Bank statement demonstrating minimum liquidity
  • Certificate from the VBG confirming accident insurance registration
  • Employment contracts and terms and conditions
  • The Managing Director of the German entity must demonstrate reliability and a thorough understanding of labour leasing regulations in Germany.

What’s more, all documents in English must be translated into German by a certified translator. The process typically takes up to three months, though it can be extended if additional information is requested. Some documents may expire during this period, requiring parts of the process to be restarted.

Ongoing Compliance Obligations

Securing the AÜG license is just the beginning. Germany’s regulations impose strict ongoing obligations, including the guarantee of equal treatment for leased employees, covering wages, benefits, holiday entitlement, working hours, and other conditions. Licenses are generally granted for one year, with renewals requiring careful preparation and potential audits by the authority. After achieving this milestone, it is crucial to continue adhering to all guidelines.
